BETFAIR.NET – TERMS AND CONDITIONS

Betfair International Limited ("Betfair") provides a play for fun betting exchange accessible at www.betfair.net (the “Website”) on which customers can access simulated sport betting services (the “Services”) in relation to the markets available on our Website ("Markets").

In these Terms and Conditions references to "we", "us" and/or "our" will mean Betfair.

Please read these Terms and Conditions before using the Website. Please also read our Rules and Regulations and Privacy Policy. All of these documents are incorporated by reference and form part of these Terms and Conditions.

The Website is not a gambling website and you cannot bet real money or any other items of monetary value. Whilst the terms Betfair Dollars, bet, stakes or other similar terms are used in this Agreement, the Rules and Regulations and Privacy Policy and in connection with the Services it is merely a reflection of game terminology intended to assist in game participation. Betfair Dollars will not be accepted as a means of payment and can only be exchanged for prizes subject to the terms of this Agreement and the terms set out on the Website and cannot be used for any other purpose.

By registering on Betfair.net and using the Services, you agree to be bound by these Terms and Conditions relevant to your use of the Website (together "the Agreement").

We may make changes to the Terms and Conditions from time to time, and will make a new copy of the Terms and Conditions available here. You agree that you are responsible for ensuring you have read the latest Terms and Conditions. If you access the Website or use the Services after the date on which any new Terms and Conditions have been published, you agree that you shall be deemed to have agreed to the revised Terms and Conditions. The date of the latest version of these Terms and Conditions is at the bottom of this page.

CONDITIONS RELATING TO YOUR USE OF THE SERVICES

1. Registration and Account Opening
You must open an account in order to use the Services and will provide a valid email address and create a username and password. Only one (1) account per person, shared computer and/or IP address is permitted. You agree that all information provided by you when registering to use the Services is complete and accurate and that you will keep it up to date via the Website.

You must be over eighteen (18) to open an account and use the Services.

You confirm that you are not resident or located in the United States of America or its outlying territories.

2. Licence to use the Website
Betfair grants you a limited licence to access the Website provided that you comply with this Agreement.
The availability of the Website does not constitute an offer or invitation by Betfair to use the Website in any jurisdiction in which such use is illegal.

Your use of the Website confers no rights whatsoever to the content and related intellectual property rights contained on the Website. You agree not to monitor, use or copy our web pages or any of our web content, including without limitation any odds data. You will not attempt to hack, make unauthorised alterations or introduce any kind of malicious code to the Website by any means. You will not (a) reverse engineer or decompile (whether in whole or in part) any software available through the Website; or (b) make copies, modify, reproduce, transmit, alter or distribute all or any part of the Website or any material or information contained on it. Any unauthorised use or reproduction may be prosecuted.

Betfair reserves the right to withdraw or amend the Services without notice. If required Betfair may permanently close or suspend access to the Website. We will not be liable if for any reason the Website is unavailable at any time or for any period.

3. Use of our Services
It is your responsibility to verify that you are permitted to use the Services in any jurisdiction in which you are located and you agree that you will not use the Services while you are located in a jurisdiction which prohibits you from doing so. Betfair also reserves the right to monitor the location from which you access the Website and to block access from any jurisdiction at any time and in its absolute discretion.

4. Your Conduct
You will not attempt to use the Services to deliberately transfer Betfair Dollars from one account to another by attempting to match bets on a market with another account through collusion.
You must only access the Website personally using the user interface provided. Access using robot software is prohibited.
You will inform us as soon as you become aware of any errors in calculations with respect to any bet. We reserve the right to reverse bets which are the subject of such an error.
You will not disguise or interfere in any way with the IP address of the computer you are using to access the Website or otherwise take steps to prevent us from correctly identifying the actual IP address of the computer you are using whilst accessing the Website.
You agree it is your responsibility to account for any tax or duty imposed on you as a result of any prizes you win as a result of using the Services.
You will not make offensive comments, use offensive or pornographic material or make potentially defamatory or inflammatory remarks in connection with the Website including within your own username or other information contributed to the Website.

5. Privacy
Any information you send to us will be processed in accordance with our Privacy Policy. You agree that we may display your username and details of your betting activity on the Website. You authorise us, at any time, to use any means that we consider necessary to verify your identity with any third party providers of information. You agree to indemnify us and hold us harmless in respect of the release of any personal (or other) data pursuant to this Agreement.

6. Operation of our Services
The Website is supplied "as is" and use is of it is entirely at your own risk. To the fullest extent permitted by law, Betfair makes no representations or warranties of any kind, including but not limited to, the accuracy, quality or completeness of the contents of the Website. Betfair shall not be liable for any action taken by you as a result of your relying on any of this information or for any loss or damage suffered by you as a result of you using such information or any third party website linked to Betfair. Any links to third party websites do not constitute an endorsement by Betfair of any products or services available on such websites. You use such websites at your own risk and Betfair takes no responsibility for the content on, or use of, such websites. You are responsible for understanding the contents of the Website and the operation of the Services and we reserve the right to change the format of the Services in order to enhance such Services. Betfair will determine when the Markets are open for betting and may close the Markets at any time in our absolute discretion. Though we will at all times use reasonable endeavours to settle Markets as quickly as possible, we give no assurances as to the timeframe in which Markets will be settled. In the interests of maintaining integrity and fairness in the Markets we may, at our sole and absolute discretion, decide to suspend betting on a Market earlier than anticipated earlier than anticipated by our Rules and Regulations and/or void certain bets or a Market in its entirety.

7. Cancellation, Termination, Suspension and Breach
We may restrict your access to the Website, suspend or terminate your account, withdraw your offers for bets, void any bets outstanding to your account, cancel any unmatched bets or cancel and void any outstanding or matched bets in our absolute discretion without cause at any time including if: i. there is a technological failure; ii. we suspect that you are engaging in illegal or fraudulent activity; iii. we suspect that you have (or may have) breached any part of this Agreement; iv. we suspect you are acting in a manner that is detrimental to the conduct of our business or which may result in legal liability for you, us or third parties; or v. we have the right to do so as set out in our Rules and Regulations.

8. Cancellation of an offer for a bet
You may cancel unmatched bets at any time either by requesting a cancellation of the relevant offer in the relevant section of the relevant Market on the Website Your cancellation of an unmatched bet becomes effective once we send you confirmation of the cancellation. In the event that your cancellation request is not received and processed in good time, you acknowledge that your offer may remain outstanding and available for acceptance. You may not be able to cancel your offer if your bet has been partially or wholly accepted during the interval between your submitting your cancellation request and our confirming your cancellation. In this case, your original offer, or part thereof, will be validly accepted and the bet will be concluded. When you amend an unmatched bet you are effectively cancelling that bet and submitting a new bet at the amended stake or odds. We will cancel any offers for bets that remain outstanding at the time that we close a Market.

9. Bet Settlement
Subject to these Terms and Conditions we will settle Markets in accordance with our Rules and Regulations. We reserve the right to reverse or amend settlement in the event of a Market being settled incorrectly. This may lead to amendments being made to your account to reflect changes in Market settlement.

Any amount of winnings or losses relating to your bets on a Market will be rounded to the nearest two decimal places. If the amount ends in 0.5 it will be rounded up.

10. Betfair Dollars
You will be provided with 1,000 Betfair Dollars in your account on registration and this will be topped up to 1,000 Betfair Dollars at Midnight CET every day.

Betfair reserves the right to change the amount, if any, credited to your account on opening and thereafter in its absolute discretion.

11. Prizes
Betfair Dollars may be exchanged for prizes. The prizes and number of Betfair Dollars will be listed on the Website. Betfair may change the prizes or number of Betfair Dollars required to obtain a prize without notice to you. Betfair reserves the right to substitute any prize claimed for one of equivalent value. A player's account will be reset to a zero balance once a prize is received. Only Canadian residents are eligible to win prizes.

Any other promotions or prize competitions on the Website will be subject to terms and conditions these terms and conditions and any additional terms set out on the Website.

If you win a prize you may be required to provide additional proof of your identity (including but not limited to copies of identity documents and proof of address) in order to confirm your identity and eligibility to use the Services and receive prizes. You further agree to use of your name and image by Betfair and companies in its group on the Website and in promotional materials produced by or on behalf of Betfair anywhere in the world in any format or media and will provide reasonable assistance to Betfair in producing such promotional materials. You will not receive any additional consideration for this.

In the event of any dispute over the winner of a prize Betfair reserves the right to withhold the prize pending resolution of the issues. Betfair’s decision regarding the recipient of any prize will be final.

By claiming the prize, the winner authorizes the use, without additional compensation of his or her name and/or likeness and/or voice/photograph and municipality of residence for promotion and/or advertising purposes in any manner and in any medium (including without limitation, radio broadcasts, newspapers and other publications and in television or film releases, slides, videotape, distribution over the internet and picture date storage) which Betfair.net may deem appropriate.

CONDITIONS RELATING TO USE

12. Matters beyond our reasonable control
We are not liable for any loss or damage that you may suffer because of any: act of God; power cut; trade or labour dispute, act, failure or omission of any government or authority; obstruction or failure of telecommunication services; or any other delay or failure caused by a third party or otherwise outside of our control. In such an event, we reserve the right to cancel or suspend the Services without incurring any liability. We are not liable for the failure of any equipment or software howsoever caused, wherever located or administered, or whether under our direct control or not, that may prevent the operation of the Services, impede the placing of offers for bets or the matching of bets, or prevent you from being able to contact us. We will not be liable for any failure to perform by a third party to our Agreement.

13. Indemnity
You agree to indemnify and hold us and our associated companies, affiliates, officers, directors, agents and employees harmless from any liabilities, claims, losses or demands made by any third party arising out of your breach of this Agreement (including documents incorporated by reference) or out of your violation of any law or the rights of any third party.
You acknowledge that Betfair and its affiliates will hold information with respect to your identity, including but not limited to your name, address and payment details.
You agree that we rely on this information in entering into this Agreement and you agree to hold us harmless against any falsehood or inaccuracy contained in the information you provide us.

14. Limitation of liability
We exclude all representations and warranties as to the satisfactory quality and/or fitness for its intended purpose and/or accuracy and completeness of the Services.
We will not be liable to you for any loss that you may incur as a result of misuse of your password and we accept no liability resulting from its unauthorised use, whether fraudulent or otherwise.
In no event will we, or any of our suppliers, accept any liability however arising for any losses you may incur as a result of using the Services. Under no circumstances will our liability under this Agreement or for breach of contract, tort, equity or otherwise exceed CAD 500 (five hundred Dollars). Under no circumstances will we be liable for any indirect, special or consequential damages, loss of profits (direct or indirect) or the benefit of any bet arising from breach of contract, negligence, equitable duty (including for the avoidance of doubt in relation to any bet(s) or Market(s) voided by us) or other liability even if we had been advised of or known (or should have known) of the possibility of such damages or loss.
Nothing in this Agreement excludes our liability with respect to death and personal injury resulting from our negligence, or that of our employees, agents or subcontractors.

15. Intellectual property
The Sporting Exchange Limited ("TSEL"), part of the Betfair group of companies, is the owner of:
• all copyright and related rights in and to the Website, including, without limitation, rights in databases and all rights in any data and related content on the Website except for certain third party rights (referred to below);
• all trade mark rights, whether registered or unregistered, in and to BETFAIR and the BETFAIR logo; and
• the domain name www.betfair.net which is our uniform resource locator ("URL").
Any unauthorised use of any of these rights may result in prosecution or other action being taken against you.
You hereby assign to TSEL absolutely, any and all copyright and other intellectual property rights throughout the world in all media whether now known or hereafter developed, for the full period of copyright, including by way of present assignment of future copyright and all other rights whatsoever, in any offers for bets or bets placed by you on the Website.
Any data licensed to Betfair and/or TSEL from third parties is provided for use on the Website only and may not be used for any commercial purposes without the consent of such third parties.

GENERAL CONDITIONS

16. Assignment
You may not assign any part of this Agreement without Betfair's written consent but Betfair may assign any or all of this Agreement to any third party at any time without notice to you.

17. Severability
In the event that any provision of this Agreement is deemed by any competent authority to be unenforceable or invalid, the relevant provision shall be modified to allow it to be enforced in line with the intention of the original text to the fullest extent permitted by applicable law. The validity and enforceability of the remaining provisions of this Agreement shall not be affected.

18. Amendments
We reserve the right to make changes to the Website and all guides and policies included on the Website, including this Agreement at any time. You will be subject to the guides, policies, conditions and agreements in force at the time that your bets are matched. It is therefore your responsibility to check the guides, policies and this Agreement from time to time to ensure that you agree with them, and your continued use of the Services will be deemed to be your acceptance of any changes we may make.

19. Communications and notices
Communications and notices to be given by you to us under this Agreement (other than those exchanges of information occurring in the normal operation of the Website) should be provided to us as set out in the Contact us section.

20. Entire Agreement
This Agreement and the terms expressly incorporated into them constitute the entire and only agreement between the parties with regards to its subject matter and each party confirms that it has not been induced to accept this Agreement in reliance upon, nor has it been given, any warranty (including in particular any warranty as to merchantability, fitness for purpose or uninterrupted functionality), representation, statement, assurance, covenant, agreement, undertaking, indemnity or commitment of any nature whatsoever other than as are expressly set out in this Agreement and, to the extent that it has been, it unconditionally and irrevocably waives any claims, rights or remedies which it might otherwise have had in relation thereto.

21. No waiver
No failure or delay by a party to exercise any of its rights under this Agreement shall operate as a waiver thereof and no single or partial exercise of any such right shall prevent any other or further exercise of that or any other right.

22. Governing Law and Jurisdiction
This Agreement is governed by the laws of Malta and the parties hereby submit to the non-exclusive jurisdiction of the courts in Malta in relation to all disputes under this Agreement.

23. English language version
In the event that this Agreement has been prepared in various languages other than English for reference only. In the event of any differences between the English version of this Agreement and any non-English versions, the English version shall prevail.
